The buyer = the customer
PREAMBLE
Beyond-the-dust.fr is the property of Mélanie JAYTENER in its entirety, as well as all rights relating thereto. Any reproduction, in whole or in part, is systematically subject to the authorization of the owner.
ACCEPTANCE OF TERMS
The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen and expressly declares to accept them without reservation.
These General Terms and Conditions govern the contractual relations between Beyond The Dust (Mélanie JAYTENER) and its client, with both parties accepting them without reservation.
These General Terms and Conditions will prevail over any other conditions appearing in any other document, unless otherwise waived, expressly and in writing.
PRODUCTS
The products sold by the site are identified by one or more photos, a descriptive text and a price including tax in euros. These photographs do not fall within the contractual scope. If errors are introduced, Beyond The Dust cannot be held responsible under any circumstances.
Products purchased following a visit to the workshop and whose condition the customer was able to see before purchase, cannot be the subject of a refund or discount request for any defect that the customer considers to have seen after purchase.
The furniture and objects offered are old, so they contain traces of time, scratches and defects due to their age. In addition, they no longer correspond to the safety standards currently in force in France and abroad. It is therefore up to the buyers of these objects to ensure their proper use.
PRICE-PAYMENT
The price is expressed in euros. The price indicated in the order confirmation is the final price, expressed all taxes included without VAT (article 293B of the tax code) for France and EEC countries. VAT not applicable, art. 293B of the CGI
Payment is made via the website or by credit card at the showroom in a secure manner.
The seller reserves the right to refuse an order from a customer with whom a payment dispute has taken place or is in progress.
ORDER
The sale will only be concluded upon payment of the order.
The information provided by the buyer when taking the order binds the buyer: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
DELIVERY – COLLECTION DELIVERY:
Beyond The Dust ships after payment has been collected:
1- By Poste Colissimo for small products.
2-By its own care bulky parts within a radius of 70 km around our showroom (on quote)
3- By carrier for bulky parts that are to be shipped beyond the area mentioned above. Beyond The Dust subcontracts this service and reserves the right to choose the carrier.
Delivery is made at the foot of the building and the carrier cannot take back the delivered goods, so be sure to check the dimensions of your stairwells and access doors before ordering.
4- You can also choose to pick up your product at our showroom by appointment. Contact us!
After order confirmation, Beyond The Dust undertakes to ship all references ordered by the buyer, within 1 to 3 weeks for delivery via carrier or 7 working days for items delivered by Colissimo / point relay (excluding holidays). Delivery times are always given as an indication. Their excess cannot justify the cancellation of your order without prior agreement from us. The Buyer is delivered to his home or to a relay point.
In the case of delivery by colissimo and in the event of absence, the Buyer or the recipient of the ordered product receives a delivery notice from La Poste, which allows him to collect the ordered products at the nearest post office. close, for a period of fifteen days. If the customer does not collect their package from the post office within 15 days and it is returned to Beyond The Dust, a contribution to the shipping costs for reshipment will be requested (if the product arrives in good condition) and it will not be possible to cancel the order and request any refund. If within 45 days of sending the product, the customer does not respond, Beyond The Dust reserves the right to relist the item.
The Buyer is required to check, in the presence of the delivery person, the condition of the packaging of the goods and its contents upon delivery. In the event that the Buyer has any doubt of any nature whatsoever about the condition or contents of his package, he is required to apply the following procedure (in particular reporting any damage observed, any complaints and reservations) and to refuse the goods by immediately issuing a report of anomaly to the carrier. Please report these incidents to the Seller within 48 hours, attaching a copy of the anomaly report (with photos) made to the carrier.
Pickup at the showroom
If the buyer himself is responsible for picking up the furniture from the workshops, he is required to check the condition of the furniture before purchase. Once the purchase has been made and the furniture has left the Beyond The Dust workshops, no complaints or reversals can be made.
QUALITY-CONFORMITY
In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the Buyer must make his complaint within 48 hours from the date of receipt of the package. Complaints must be sent by email to hello@beyond-the-dust.fr
They must include:
- the Buyer’s contact details
- product references
- the reasons for the complaint (and photos if necessary)
The return of products must be made within seven working days. Failing this, Beyond The Dust will not provide any reimbursement for the products ordered. Any product to be exchanged or refunded must be returned to Beyond The Dust as shipped, in its original condition and packaging and include all of the product and its accessories.
Shipping costs are the responsibility of the Buyer, except in the case where the product returned or exchanged does not correspond to the original declaration made by Beyond The Dust. Coverage of these return costs will be capped at the rate corresponding to the shipment. Any risk linked to the return of the product is the responsibility of the Buyer. In the absence of non-compliance with the procedure set out above and the deadlines indicated, the Buyer will not be able to make any claim for non-conformity or apparent defect of the products delivered, the products being then deemed to be compliant and free from any apparent defect.
PRODUCT AVAILABILITY
If the ordered product is unavailable, Beyond The Dust will inform the Buyer as soon as possible. The Buyer will be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid.
RIGHT OF WITHDRAWAL
The Buyer has 48 hours from the date of receipt of the order to make a complaint if the product does not correspond to the order (defective or non-compliant). The Buyer has fourteen days from the date of receipt of the items to return the ordered products for a refund. If the error comes from Beyond The Dust, the costs of returning the item(s) will be borne by Beyond The Dust. If it is a return because the Buyer no longer wants this item, the return will be made at their expense. The products must be returned in perfect resalable condition, in their original condition (packaging, accessories, instructions for use and documentation), duly sealed.
Any product that is incomplete, damaged, damaged or whose original packaging has been damaged will not be refunded or exchanged. The Buyer is advised to use a carrier offering tracking and insurance for returned merchandise. In the event that it is lost or damaged in transport, Beyond The Dust will not be able to reimburse the Buyer who will have to make a claim directly with the carrier.
If the right of withdrawal is exercised, only the price of the product(s) purchased will be refunded. Shipping and return costs are the responsibility of the Buyer.
DISPUTES
Beyond The Dust cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from malfunction or misuse of the products sold.
Beyond The Dust's liability will, in any case, be limited to the amount of the order and cannot be held responsible for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products.
Complaints or disputes will always be received with attentive kindness, good faith always being presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will contact Beyond The Dust to obtain an amicable solution.
GUARANTEES
In all cases, Beyond The Dust cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country.
Beyond The Dust's liability is systematically limited to the value of the product in question, value at its date of sale, and this, without the possibility of recourse to Beyond The Dust or the company producing the product.
LEGAL INFORMATION
The provision of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders.
Failure to provide information will result in the order not being validated. In accordance with the “Informatique et Libertés” law, the processing of personal information relating to customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise with Beyond The Dust.
In addition, Beyond The Dust undertakes not to communicate, free of charge or for consideration, the contact details of its customers to a third party.
RESERVATION OF PROPERTY
Beyond The Dust retains full ownership of the products sold until full payment of the principal price, including fees.
During the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the Buyer. Failure by the Buyer to fulfill its payment obligations gives the Seller the right to demand immediate return of the delivered goods at the expense and risk of the Buyer.
